Epson gets default judgement against 26 Amazon resellers

The OEM has now been granted a default judgement by Judge Andre Birotte Jr. granting Epson $7 million (€5.78 million) in damages and a permanent injunction.

In August 2018, Epson America, and Seiko Epson Corp., alleged that the defendants were selling “numerous models” of counterfeit Epson-branded ink cartridges, and accordingly filed a request for a Temporary Restraining Order and Seizure against the 26 companies.

Epson was successful and the Temporary Restraining Order was granted by Judge Andre Birotte Jr. in the US District Court in Los Angeles at the end of August 2018. Shortly after Epson was granted a Preliminary Injunction against the 26 Amazon resellers.

Most recently in this case, Epson was granted a default judgement on 27 January 2021, granting Epson $7 million (€5.78 million) in damages and permanent injunction against the defendants. Defendants in this case were Oleksandr Benedychuk; Wisemine Trading Ltd.; Vasyl Kedyk; Sitrol Intertrading Ltd. A/K/A Kekrodi Intertrading Ltd.; Denis Smotrov; Denis Smotrov LLC; Anton Hashynov; Vladislav Bondarenko; Viktor Boiko; Laszlo Kedik; Andrey Klimenko; Iurii Ganychenko; Andriy Stebliv; Larysa Ponomarenko; Volodymyr Shevchun; Liliia Stakhova; Veleriya Kosolapova; Nina Kozlova; Denis Evseev; Tymur Isaiev; Ihor Kobylinskyi; Vladyslav Pankov; Andrii Pavlov; Roman Kholodov; Anton Kovalkov; Oleksandr Bobyr.

At the time Epson started this complaint, the OEM said its actions were part of its “worldwide efforts to protect the company from unfair competition of all types and assure that its customers receive the high quality products they expect.”
