Ninestar challenges inclusion on U.S. Forced Labor List

Ninestar Corporation and its affiliates are contesting their placement on the Forced Labor Enforcement Task Force list, created under the Uyghur Forced Labor Prevention Act. The U.S. Court of International Trade is set to delve deeper into the issue with a key hearing scheduled for early November.

The United States Court of International Trade is currently handling a case where Ninestar Corporation and its affiliated entities are challenging the decision by the Forced Labor Enforcement Task Force (FLETF) to include them on a list made under the Uyghur Forced Labor Prevention Act (UFLPA). This Act was established in December 2021 to prohibit imports of goods produced with forced labor and prevent the Chinese government from undermining the enforcement of section 307 of the Tariff Act of 1930.

Ninestar Corporation had filed a motion for a preliminary injunction against this decision, to which the defendants responded in opposition and sought to dismiss the case. Following a recent status conference, several orders were made by Judge Gary S. Katzmann.

The court approved the defendants’ motion for an amended protective order and that the defendants are required to provide an updated confidential version of the administrative record, governed by the terms of the protective order.

The defendants must also submit a privilege log detailing any withheld information from the updated confidential record.

Ninestar’s motion to compel the unredacted administrative record was dismissed, but they may renew it after certain conditions are met.

All parties must submit any new documents or exhibits by 30 October 2023, before a hearing is set for 2 November 2023.

The case continues with its proceedings in New York.
