Staples hit with class action over deceptive fees

Staples faces a class action lawsuit over hidden shipping fees in its AutoRestock program.

Staples Inc. has been hit with a class action lawsuit alleging that the office supply giant engaged in deceptive practices through its online AutoRestock program. The lawsuit, filed in the U.S. District Court for the District of Massachusetts by plaintiff Erin Weiler, accuses Staples of a “bait-and-switch” scheme that misled customers into believing they were receiving significant discounts, only to be hit with undisclosed shipping fees after completing their purchases.

The plaintiff claims that Staples promised discounts of up to 25% on products purchased through the AutoRestock feature but then added a $9.95 shipping fee for items under $25— a fee that was never disclosed during the checkout process. This alleged practice has led to thousands, if not millions, of customers being charged more than they anticipated.

The lawsuit asserts that Staples’ actions constitute breach of contract, unjust enrichment, conversion, and fraud. Weiler, who is seeking to represent a nationwide class and a California subclass, argues that Staples’ failure to disclose these fees resulted in customers paying significantly more than the advertised price.

The complaint calls for compensatory and punitive damages, restitution, and injunctive relief to prevent Staples from continuing these practices. The case underscores growing consumer scrutiny of e-commerce practices, particularly regarding transparency in online pricing and fees.
