Mito Color Imaging Co., Ltd has issued a statement warning that its “integrity and the reputation of its products” are being jeopardised by fraudulent sellers “misappropriating” the Mito name to sell their unauthorised toner cartridges on Amazon.
These sellers are purveying their unauthorised products via Amazon.com using the names “MitoColor” and “MitoInk”, explains the company, and in so doing they are “fraudulently misrepresenting that they are selling genuine Mito products.”
They are also infringing Mito’s registered trademark, Chinese Reg. No. 15159254 and its U.S. intellectual property rights in the “Mito” name.
Mito warns potential buyers of these unauthorised cartridges that the sellers “are unlikely to provide reliable warranty or return service if you purchase their products.”
The company explains that it does not sell any of its products using Amazon.com, adding that if consumers purchase cartridges from the fraudulent sellers “MitoColor” and “MitoInk” they could be faced with more than just unreliable products; they may be purchasing a product that infringes a U.S. patent and/or violates a general exclusion order issued by the U.S. International Trade Commission.
“This,” explains Mito, “could expose you to litigation, legal expenses, and, potentially, to monetary damages.”
The company also reveals that the unauthorised cartridges being sold by “MitoColor” and “MitoInk” are described as “brand new”, not remanufactured, and could “potentially violate” OEM patent rights.
Mito Color Imaging concludes by saying that it respects intellectual property, and is “committed to providing the best products with consistent quality and top performance” for its customers.
