Canon granted new preliminary injunction

The OEM has kicked off the week with the announcement of another patent infringement case, with Canon revealing that it has been granted a preliminary injunction by the District Court Düsseldorf.

The preliminary injunction has been granted to Canon against Media Range GmbH, which does business as “MediaRange”, as well as against the company’s managing directors.

The injunction centres around the alleged infringement of the German portion of Canon’s European patent EP 2 087 407, pertaining to a drum unit and a process cartridge. This patent has also been the subject of numerous Report Infringement Forms filed by Canon with various divisions of Amazon.

As Canon explains, the preliminary injunction it has obtained in Germany enjoins Media Range GmbH from offering and distributing laser toner cartridges comprising a drum unit with a certain coupling member, via, for example, www.amazon.de and www.mediarange.de.

The infringing cartridges can replace the OEM cartridge models HP CE505X and HP CF280X which are compatible with HP laser beam printers. Furthermore, states Canon, the preliminary injunction contains a claim for sequestration, so the infringing cartridges have been handed over to a bailiff until the matter is finally solved.

Defendants have the option to file an objection against the preliminary injunction. However, as service on the Defendants was effected, Canon says it can enforce this decision.
