Markman order clears Aster products

Aster Graphics has announced that the recent Markman order issued by the Administrative Law Judge Dee Lord clears its products of the patent infringement alleged by Canon.

As Aster explains, on 28 February 2019, Dee Lord issued a Markman order as part of Canon’s USITC investigation No. 337-TA-1106. This investigation was focused on allegations of infringement of Canon’s U.S. patents ‘826, ‘021, ‘729, ‘764, ‘765, ‘960, ‘846, ‘727, and ‘728.

Earlier this week, Static Control revealed that the Markman order had cleared its dongle gear of alleged patent infringement. Now Aster has followed suit, revealing, “On the most critical interpretation, as to whether the coupling member can incline with the photosensitive drum, she [Lord] did find that the patents require the coupling member to be pivotable. Aster gears do not pivot.” As a result, the company continues, “Aster expects that based on the Markman Order, a non-infringing Summary Determination will be issued for Aster by the ITC Judge Dee Lord.”

The company concludes, “In looking back, Aster was proud to be the first imaging products producer to provide solutions for ALL accused products named in the ITC 337 Investigation. As noted in Canon’s August 2017 “SUPPLEMENT TO JOINT STIPULATION REGARDING REPRESENTATIVE ACCUSED PRODUCTS,” Canon had admitted that Aster’s new design does not infringe and that the new design would not be subject to any exclusion order the ITC may issue. Aster Graphic’s products have never been subject to a seizure order and our product supply has never been interrupted.”
