The complaint was initially filed by Canon in September 2020, alleging Ninestar infringed Canon’s U.S. Patent Nos. 9,851,688; 9,857,766; 10,620,582; 10,712,709; and 10,712,710.
Canon announced in September the filing of a complaint in the U.S. District Court for the Central District of California against Ninestar Corporation, Ninestar Image Tech Limited, and Ninestar Technology Company, Ltd. (collectively, “Ninestar”), for infringement of its U.S. Patent Nos. 9,851,688; 9,857,766; 10,620,582; 10,712,709; and 10,712,710.
Canon alleged that Ninestar sells toner cartridges that infringe Canon’s patents for use in various models of Canon and HP laser beam printers. These include printers which accept Canon toner cartridge models 729 and HP toner cartridge models 126A and 130A.
Today, Canon announced it and Ninestar have resolved their pending lawsuit and it has filed a Notice of Dismissal with the U.S. District Court for the Central District of California, stating it “hereby notices the dismissal with prejudice of this entire action, with each party to bear its own attorneys’ fees and costs.”
Ninestar said in its statement: “Without admitting any wrongdoing, in order to amicably resolve the lawsuit, Ninestar has agreed to stop making, using, selling, and offering for sale in the U.S., and importing into the U.S., the toner cartridges that Canon accused of infringement. ”
