Canon concludes Coemedia case

The OEM has announced the end of its latest legal pursuit, with a settlement agreement with Coemedia GmbH.

The initial lawsuit came after Canon accused Coemedia of infringement of the German portion of Canon’s European Patent, EP 2 087 407 B1, in relation to a drum unit and a process cartridge.

Last year, Canon received a preliminary injunction from the District Court of Düsseldorf, which prohibited Coemedia from selling, distributing, or offering for sale any toner cartridges containing a drum unit that violating Canon’s intellectual property.

Now, the OEM has revealed that Coemedia and its Managing Director have signed a settlement agreement, and inter alia accepted the court’s preliminary injunction as final and binding.

It was also announced that Coemedia will pay damages to Canon for past infringements; all other settlement details remain confidential.

The news follows a previous settlement agreement reached by Canon earlier this year in its dispute with Moreinks Limited, based on similar claims of infringement of the aforementioned patent, and with a similar outcome, Moreinks agreeing to pay the OEM for past damages. That agreement also came following a preliminary injunction.
