Canon launches a fresh slew of removal requests

The OEM has once again returned to the fray regarding patent infringement on Amazon, filing further Report Infringement Forms requesting the removal of various toner cartridge listings.

Canon Inc. announced the filing of a Report Infringement Form with Amazon ES based on the alleged use of claims 1 and 2 of the Spanish portion of Canon’s European Patent EP 1 977 289 (“EP ‘289”) regarding the cartridge model “CB540A” offered by Herreros y Socios SL under the ASIN B071SGXYZJ.

Afterwards, Amazon took down the respective product. This product is compatible with the OEM HP cartridge model and provides a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. Furthermore, it comprises an elastic portion according to claim 2 of EP ‘289.

Canon also filed another Report Infringement Form with Amazon ES regarding the cartridge models “CB541A” and “CB542A” offered by Hamle UG haftungsbeschränkt under the ASINs B01M75H3AV and B01M5JZWR6.

Amazon also took down these products, which are similarly compatible with the OEM HP cartridge models and comprise a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. They also comprise an elastic portion according to claim 2 of EP ‘289.

Finally, Canon announced the filing of Report Infringement Forms with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by Techsupplies 99 for use in HP laser beam printers.

Canon’s infringement report alleged that certain model CE311A, CE312A and CE313A toner cartridges sold by Techsupplies 99 via Amazon.com infringed Canon’s U.S. Patent No. 8,688,008. Canon requested that Amazon remove Techsupplies 99’s listings for those products, namely, Techsupplies 99’s listings with Amazon Standard Identification Number B072QZ595P.

At the time of this announcement, the above-identified Techsupplies 99 listings were no longer available on Amazon.com.
