Color Imaging, Inc has issued a statement regarding the settlement of the company’s long-running patent infringement lawsuit filed by Canon in a Georgia district court.
Canon was originally awarded $4.5 million (€3.8 million) in June 2017, following the finding by a federal jury that both Color Imaging, Inc and General Plastic Industrial Co., Ltd had infringed the OEM’s 7,647,012 (012) patent.
However, this was not the end of the dispute, as both companies responded with a Motion for Judgement as a Matter of Law, New Trial and Remittitur in the U.S. District Court for the Northern Division of Georgia, Atlanta Division. This motion was subsequently denied by the court, which found that the defendants had failed to demonstrate that there was “a manifest error of law”.
Now, Color Imaging has released a statement regarding the case, in which both parties have reached a settlement agreement with Canon.
“Canon and Color Imaging, Inc. have agreed to resolve their pending lawsuit in the U.S. District Court for the Northern District of Georgia regarding Color Imaging’s alleged infringement of Canon’s U.S. Patent No. 7,647,012. To resolve the lawsuit, Color Imaging will stipulate to a consent judgment and permanent injunction that prohibits it from making, importing, using, selling, and offering for sale the toner bottle products that Canon accused of infringement.”
