Carlos Garza has been found guilty of defrauding Xerox by way of a toner scheme and has been ordered to pay the OEM a restitution sum of $1.3 million (€1.1 million).
As the Democrat & Chronicle reports, Garza was “convicted of conspiracy to transfer stolen property in interstate commerce” and was ordered to repay Xerox over a million dollars, as well as being sentenced to five years’ probation.
Xerox, which provides branded printing toner to customers “who sign lease contracts” has been taken advantage of before, with two Florida men also recently found guilty of perpetrating a toner scheme against the OEM.
Explaining how Xerox’s toner contracts work, US Attorney Richard A. Resnick said, “At all times, unused toner remains the property of Xerox, and customers cannot sell the toner”.
Garza’s scheme was perpetrated between 2010 and 2015, when he bought toner from truck drivers working for shipping companies, which were returning the toner to Xerox, as well as from “Xerox agent-owners who should not have had toner to sell,” according to Resnick.
During the course of those five years, Garza stole $1.3 million (€1.1 million) worth of toner from the OEM, a sum he has been ordered to pay back.
