As the Brexit transition period is due to close in three months on 31 December 2020, ECHA issues a timely reminder to transfer your UK-based dossier to EU before the deadline.
The transition period for the UK withdrawal from the EU will end 31 December 2020 and ECHA, the Helsinki based European Chemical Agency, is urging companies to check if they are affected by the withdrawal, and UK-based registrations and authorisations should be transferred to an EU Member State before the end of the transition period.
Downstream users in the EU/EEA should check the list of substances registered only by UK companies on ECHA’s website to see if they will be affected and need to take action before the end of the transition period.
The UK withdrew from the EU on 31 January 2020. As of 1 February 2020, the transition period provided for in the Withdrawal Agreement applies until 31 December 2020. During the transition period, EU law continues to apply to and in the UK. UK based companies are advised to transfer registrations and other assets to EU companies before the end of the transition.
If your company is established in the EU/EEA, you will be affected whenever your supply chains as a customer or supplier extend to the UK.
If your company is established in the UK, the EU chemicals legislation, which includes REACH, CLP, BPR and PIC, will no longer apply to you after the transition period if your chemical substances, mixtures or articles, biocidal products or active substances are placed on the market only in the UK. This is also the case if you export certain chemicals directly to non-EU/EEA countries from the UK.
If your business is in any way connected to the remaining 27 EU Member States or the EEA countries, you will have to prepare for changes.
