Toshiba accused of patent infringement

K. Mizra has filed a complaint for patent infringement alleging Toshiba has infringed some of its patents.

Following the transfer by Sharp of its MFP-focused patents to K. Mizra (Mizra), a patent licensing company, Mizra is now bringing this action against Toshiba to enforce these valid and subsisting United States patent rights.

The patents in question relate to technology used in MFPs and are U.S. Patent No. 7,064,874 (“the ?874 Patent”), U.S. Patent No. 7,570,400 (“the ?400 Patent”), U.S. Patent No. 7,852,504 (“the ?504 Patent”), U.S. Patent No. 8,274,711 (“the ?711 Patent”), U.S. Patent No. 10,018,938 (“the ?938 Patent”) and U.S. Patent No. 7,840,165 (“the ?165 Patent”).

Mizra alleges that technology used in Toshiba’s e-Studio devices infringes its patents and explained in its complaint: “Toshiba previously entered into a patent license agreement with Sharp which has since expired. On information and belief, at least as a result of that license agreement, Toshiba has had actual knowledge of the Asserted Patents and, as of the expiration of that license agreement, Toshiba has had actual knowledge of its infringement of the Asserted Patents.”

The complaint was filed in the United States District Court Middle District of Florida Orlando Division and the defendants are Toshiba Corporation, Toshiba TEC Corporation, Toshiba America Business Solutions, Inc., American Business Systems, Inc., Clearview Business Solutions LLC, and Copy Concepts Inc.

In June, Mizra filed a complaint against HP, also alleging patent infringement.
